LIMITED PRODUCT WARRANTY

Saint-Gobain India Private Limited, with its registered office at Level 7, Chettinad Sigapi Achi Building, 18/3, Rukmani Lakshmipathi Road, Egmore, Chennai – 600008 (hereinafter, the “[Saint-Gobain E-Commerce Platform]”, “We”, “Our”, “Us”), provides the below limited product warranty (hereinafter, “Warranty”) in respect of the Product.

For the purpose of this Warranty, “User”, “You”, “Your” shall mean the original and immediate purchaser of the Product, and/or the invoice against the purchase of the Product, from the Website. All capitalized terms used and not defined herein shall have the meaning set forth in the Terms of Use.

Before You use the Product, please read this Warranty thoroughly. By keeping or using the Product, You will be deemed to have unconditionally agreed to this Warranty, and they shall govern Your use of the Product.

1. WHAT IS COVERED AND FOR HOW LONG?

The Saint-Gobain E-Commerce Platform warrants that for the period of 6 month (“Warranty Period”) the Product shall be free from any defects in materials and workmanship under normal application, installation, use and service conditions. The Warranty Period shall start from the date of invoice and shall automatically terminate upon the expiry of the Warranty Period even if the Product has not been installed after purchase or has not been in use for any part of whole of the Warranty Period for any reason whatsoever.

You acknowledge that the Product, at the time of delivery, was undamaged and free from any defects, and agree that the warranty for the Product shall be subject to the exclusions, limitations, terms and conditions specified in this Warranty and Schedules (if any) hereto forming integral part of the Warranty. This Warranty is a limited warranty and constitutes the only express warranty extended by the Saint-Gobain E-Commerce Platform in relation to the Product.

EXCEPT FOR THE EXPRESS LIMITED WARRANTY DESCRIBED HEREUNDER, THERE ARE NO EXPRESS OR IMPLIED WARRANTIES OF ANY KIND AND THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE PRODUCT OR ANY PART OR COMPONENT THEREOF AND NO WARRANTY SHALL BE IMPLIED BY OPERATION OF LAW OR OTHERWISE. IN NO EVENT SHALL THE SAINT-GOBAIN ECOMMERCE PLATFORM BE LIABLE TO ANY PERSON OR ENTITY FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR CHARGES FOR ANY REASON, EVEN IF SUCH DAMAGES OR CHARGES ARE FORESEEABLE OR THE SAINT-GOBAIN E-COMMERCE PLATFORM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CHARGES.

 

2. WARRANTY CLAIM PROCEDURE

  1. If any defect is found in the Product due to the material or workmanship, during the Warranty Period, the Saint-Gobain E-Commerce Platform may, at its sole option and discretion, and consequent to any inspection of the Product, may repair or replace free of cost, any defective component or part of the Product, subject to the terms and conditions contained in this Warranty.
  2. This Warranty is only effective during the Warranty Period and, if proof of purchase (original sales invoice and payment receipt) is provided with all warranty claims or requests hereunder furnishing all requisite details for warranty claims or requests as per Schedule A.
  3. The Saint-Gobain E-Commerce Platform shall have the right to either examine the Product where it is located or, in its sole discretion, issue shipping instructions for return of the Product. the Saint-Gobain E-Commerce Platform’s inspection in response to a warranty claim shall not constitute acceptance or acknowledgment of the claim’s validity. You agree to prepay all transportation charges for such return
  4. The Saint-Gobain E-Commerce Platform shall use reasonable efforts to resolve a warranty claim as soon as possible. However, You acknowledge and understand that response times will vary depending upon the nature of the Your claim, the location of the Product and the availability of resources required with the Saint-Gobain E-Commerce Platform.

3. EXCLUSIONS & LIMITATIONS

  1. This Warranty remains applicable only if the Product has at all times been used strictly in accordance with the terms of this Warranty and the Product’s user manual. The Saint-Gobain E-Commerce Platform shall not be responsible, in any manner whatsoever, if the Product is improperly or negligently handled, or in cases of wrong installation, improper use, misuse, negligence, abnormal use, insufficient care, tampering or vandalism. You agree that all such aforesaid actions will automatically terminate and nullify this Warranty
  2. In the event of non-availability of components or parts of the Products due to any reason whatsoever, the Saint-Gobain E-Commerce Platform shall not be responsible or liable for any delay that may be caused to service/repair of the Product. In the event that the same model or colour of the Products is not available for replacement, the Saint-Gobain E-Commerce Platform shall replace the defective Product with an equivalent model or colour as per the availability with The Saint-Gobain E-Commerce Platform at the time of such replacement.
  3. Products purchased from any other website or retailers also considered unauthorized. No Warranty applies to such products since the authenticity of the same cannot be ascertained. Please follow our Installation guidelines as set out in Schedule B.
  4. Warranties for Product will be void if corrosive or ammonia-based cleaning products are used, or the edges or if the edges and back of the Product are not kept dry
  5. Excluded from warranty coverage is any damage to the exterior deemed reasonable wear and tear such as scratches and/or fading of colour. In addition, the Warranty does not apply to damage caused by abnormal or unreasonable use of Product or any of its components. Warranty will not apply if there is any abuse of the Product in any manner or contrary to guidelines in user manuals.
  6. The Warranty does not cover normal preventive maintenance items, cleaning of the Product or problems caused by lack of preventative maintenance, improper cleaning, improper installation or occasioned by electricity fluctuations.
  7. The Saint-Gobain E-Commerce Platform assumes no responsibility for failures resulting from improper use or handling, misuse, abuse, neglect, transportation, installation of the Product, that have adverse effects on the Products, exposure to adverse environmental conditions, including but not limiting to, alkalis, acids or sharp objects or works that may have a detrimental effect on the Product, or improper cleaning practices, or by the act of god. After delivery to carrier, Product breakage is not warranted under any circumstances.
  8. The Saint-Gobain E-Commerce Platform shall not be responsible or liable for any artificial or unnatural deterioration of Product in following circumstances where the Product is damaged on account of (i) poor maintenance ; (ii) failure to cover the Product on all sides; (iii) failure to ensure that the Product is cleaned regularly with water, mild detergent solution or soft solvents; (iv) use of solvents where the pH level is not in the range from 5 to 8; (v) use of abrasive material which damages the coating; (vi) inappropriate use of the Product; (vii) improper handling, stacking or storing of the Product; (viii) defective glazing and fabrication; (ix) improper removal or installation; (x) failure to use mechanical method of handling glass, wherever necessary or so advised; (xi) contact with tree branches, window coverings, blinds, curtains or other items/objects which are abrasive; (xii) improper movement or placement of Product; (xiii) if the Product is subject to abnormal stresses from the load application of heat, excessive vibration, building or foundation movement; (xiv) lack of adequate expansion or contraction provisions in the framing members; (xv) if the Product is glazed with materials which do not remain resilient; and/or (xvi) if the methods and materials used in glazing the Product do not completely repel water.

6. WARRANTY OF REPAIRED/ REPLACED PRODUCT

  1. In the event of any repairs/ replacement of the Product or any parts thereof, this Warranty shall thereafter continue and remain in force only for the unexpired portion of the Warranty Period, subject to the Saint-Gobain E-Commerce Platform acceptance of the warranty claim.
  2. Any time consumed for the repair/ replacement of the Product and/or parts thereof, including transit of the Product or its parts, or any period during which the Product has not been used, whether under warranty or otherwise, shall not be excluded from the Warranty Period and no extension of the Warranty Period shall be granted.
  3. For the avoidance of doubt, the Warranty Period is not renewed in respect to Product that The Saint-Gobain E-Commerce Platform supplies as warranty replacements for defective Product.

7. LIMITATION OF LIABILITY

In no event shall the liability of The Saint-Gobain E-Commerce Platform exceed the purchase price of the Product, for which, the warranty claim is made by the You. We will, under no circumstances, whether as a result of breach of contract or warranty, tort, or otherwise, be liable for any incidental, special or consequential damages, including lost profits or revenues or any other costs or damages.

8. FORCE MAJEURE

The Saint-Gobain E-Commerce Platform shall not, in any manner whatsoever, be liable or responsible to You, under this Warranty, if any claims under this Warranty arises out of any non-performance or delay in performance of any terms and conditions of sale of the Products, including without limitation this Warranty, due to and without limitation, acts of god, war, civil disturbances, acts of terrorism, strikes, quarantine, pandemic, epidemic, lockouts, change in law or policy, acts of government, or any unforeseen events beyond the control of The Saint-Gobain E-Commerce Platform (collectively, “Force Majeure Events”). The Saint-Gobain E-Commerce Platform shall not be liable to service the Products’ damages or defects arising from or caused due/in relation to any Force Majeure Event during the Warranty Period.

9. JURISDICTION & DISPUTE RESOLUTION

This Warranty shall be governed, construed, and enforced in accordance with the laws of India, without regard to its conflict of law rules. You hereby submit to the exclusive jurisdiction and venue of the courts located in the Saint-Gobain E-Commerce Platform in connection with any matter arising out of, or relating to the subject matter of, this Warranty. 

10. ENTIRE WARRANTY

  1. For all the Products sold in India, only this Warranty document is applicable. Reference to any other warranty document will not be applicable or considered.
  2. The Saint-Gobain E-Commerce Platform expressly reserves the right to add to/or alter, modify, change or vary all or any of the terms under this Warranty, or to withdraw them altogether, from time to time with due intimation to the You. The modified Warranty will be communicated updated on the Saint-Gobain E-Commerce Platform’s website, as may be amended from time to time.
  3. Any implied warranty of The Saint-Gobain E-Commerce Platform, whether written or oral, expressed or implied, will not be valid.
  4. This Warranty shall be read along with the user manual and installation manual of the Product, and this Warranty shall not override any user manual, installation manual or terms and conditions under which the Product is purchased.
  5. Enclosed with this Warranty are the following attachments, which are inseparably part of this Warranty:

  6. You agree that You have not relied on any representation or warranty of the Saint-Gobain ECommerce Platform that is not expressly stipulated in this Warranty.

SCHEDULE – A

HOW TO MAKE A WARRANTY CLAIM

  • To submit and/or avail a warranty claim, please contact us on support.india@saintgobain.com
  • Telephonic enquiries shall be directed to toll free no. 18001021215 from Monday to Saturday between 09:00 Hrs. and 8:00 Hrs. (Excluding public and national holidays).
  • Please provide all applicable information regarding your claim that also shall include:
    • Product/Model Number;
    • Proof-of-purchase (copy of your original sales invoice and payment receipt, purchase order, or invoice), the date when the product was purchased from the Website.
    • Complete description of the problem with supporting documentation/s as applicable and wherever pictures are required to substantiate the claim.

SCHEDULE – B

Installation GUIDELINES

In order to have a prolonged satisfaction on the Products in terms of functionality, appearance and aesthetic it is strictly advised to follow the below mentioned guidelines as any damage happening to the Product due to non-compliance of below activities is not covered under this Warranty.

A. DO’s

  • Check the Product and packaging thereof for any damage before accepting its delivery.
  • Ensure that Product is installed correctly as per the specifications provided.
  • Use the appropriate tools for installation.
  • Refer to Installation booklet and/or User Manual enclosed, for installation guidelines of the Product.
  • Check the date of manufacturing on Product. And in case it is not available, preserve the original invoice of the Product till completion of Warranty Period.

B. DONT’S

  • Do not customize the Product installation. Adhere to the specifications provided for installation.
  • Do not tamper and/or misuse the Product.
  • Do not cut the connectors on wire, the warranty gets void if the connectors are found cut.
  • In case of waterproof products, do not submerge the product in water, it is only splash proof.
